USCIS has thus officially announced that in FY-2021 H-1B cap season, the employers must file online the "Registration" form between March 1, 2019 and March 20, 2019 with the payment of $10.00 fee online. USCIS will then run computer random selection process using the Registrations received. The winners will then be notified by the USCIS to file the I-129 H-1B cap petitions throughout the FY-2021 cap season. Employers who receive the winner notice from the USCIS will be given only "60 days" from the date of winner notices to file the H-1B cap petitions with the USCIS. Accordingly, H-1B cap petition filing and processing will be spread out throughout the cap season, helping the USCIS to manage the H-1B cap processing workload management throughout the cap season. This new two-tier system will also help the employers in two ways. Firstly, some employers may not be burdened with filing of "Premium Processing Requests" with additional expenses. Secondly, since lottery is done with the "registration" rather than H-1B petition itself, employers may save tremendously the expenses in that the employers do not have to waste expensive filing fees unless their cases are selected. Additionally, employer's filing process may undergo some changes.
